## Terms and Conditions of Service – Private End-of-Life Consulting

**Effective immediately upon booking services.**

### 1. Scope of Service – Mandatory Requirements
– **Clients MUST be actively working with both a licensed funeral director AND a licensed hospice provider at the time of booking.**
– The consultant is **currently in funeral school and is not yet a licensed funeral director**. This service **does NOT replace, substitute, or fulfill any duties of a licensed funeral director**.
– Services are strictly **non-medical** and **non-religious**.
– The consultant provides **coordination, operational oversight, and logistical management** only.
– All services are **package-specific** (Consultation, Notary Services, After-Death Logistics, Bedside Presence, Extended Support) and are **not interchangeable** unless booked explicitly.
– While the consultant holds PCA/CNA credentials (license pending), **no medical, clinical, or caregiving services are provided**.
– The consultant is **not a lawyer** and does not provide legal advice.

> **Important:** If a client is not engaged with both a licensed funeral director and hospice provider, **service bookings will be immediately declined**. No exceptions.

### 2. Booking & Scheduling
– All engagements are arranged in **four-hour intervals**, with extensions available if requested and scheduled.
– Consultations may be conducted **in person** or via a **secure, private video conference**.
– Video consultations are transmitted digitally; the consultant is not responsible for **technical failures or interruptions beyond their control**.
– Clients are responsible for **having documents, information, and relevant parties prepared** prior to service commencement.

### 3. Cancellation & Rescheduling
– Cancellations with less than **24 hours’ notice** incur a fee equal to **50% of the booked service**.
– No refunds are offered for services rendered or scheduled.
– The consultant may **reschedule or cancel** due to natural disasters, acts of war, or inclement weather.
– The consultant may **cancel at any time** if the client, household members, or family display hostile, abusive, or threatening behavior.

### 4. Payment
– Payment is due **prior to service commencement** via agreed-upon methods.
– Additional hours beyond the booked interval will be billed at the **standard hourly rate**.
– Minimum notice for requesting additional hours is **two hours prior** to service start.

### 5. Transportation
– The consultant **does not provide transportation in their own vehicle**.
– Clients are responsible for arranging their own transportation.
– The consultant may **refer clients to vetted in-home care or private transportation services** to ensure discreet and seamless transit.
– The consultant is **not liable for accidents, damage, or delays** arising from client-arranged transportation.

### 6. Client Conduct
– Clients agree to maintain a **professional and respectful environment**.
– Services may be **suspended or terminated** if the client or associated parties act in a hostile, threatening, or abusive manner.

### 7. Liability
– The consultant is not responsible for any **legal, medical, or financial consequences** arising from client decisions.
– Clients acknowledge that these services **do not replace professional legal, financial, or medical guidance**.
– Clients assume full responsibility for compliance with applicable laws and regulations.

### 8. Confidentiality & Discretion
– All client information, household details, and service activities are treated with **strict discretion**.
– Information will not be disclosed to third parties except as **legally required**.

### 9. Force Majeure
– The consultant is not liable for delays, rescheduling, or cancellations due to **events beyond reasonable control**, including natural disasters, acts of war, or severe weather.

### 10. Additional Provisions
– **Indemnification:** Clients agree to **hold the consultant harmless** from any claims arising from use of services.
– **Non-Transferable / Non-Assignable:** Services are **for the named client only** and cannot be transferred without prior consent.
– **Emergency Protocols:** Clients must contact **911 or appropriate authorities** for medical emergencies.
– **Photography / Recording Policy:** Recording of services is **prohibited** unless agreed in advance.
– **Governing Law:** Virginia law governs this agreement.
– **Severability:** If any provision is found invalid, the remainder remains in effect.
– **Entire Agreement:** This document constitutes the **entire agreement** between client and consultant, superseding any verbal assurances or representations.
– **Acknowledgement:** By booking services, clients **affirm that they are currently engaged with both a licensed funeral director and a licensed hospice provider** and acknowledge **understanding and acceptance** of these Terms & Conditions.
